KILLERS TRY TO ASSASSINATE FRANCISCO RAMIREZ
THE PRESIDENT OF SINTRAMINERCOL
EVENTS:
1.- Francisco Ramírez Cuellar, the president
of mining union Sintraminercol left his home with his girls to take
lunch at 1:30 p.m. on Sunday 10th October. On arriving at the corner
of 49th Street and 5th Avenue in the Palermo district of Bogotá,
he spotted a red and black high cylinder motorbike ridden by two
people and coming towards him. The passenger was looking at him
fixedly and had a pistol in his right hand resting on his leg. Francisco
immediately got behind electricity and telephone cabinets denying
the killers a target to shoot at. At that moment the traffic lights
that were red changed to green and on the insistence of the vehicles
behind then, the motorcyclists took off taking the road to the south.
2.-Francisco Ramírez noted that the motorcycle
did not have number plates and that the two riders were not wearing
the legally required reflective jackets or helmets. That day as
in previous days watchers had been seen around Francisco Ramírez’s
home, and it is presumed that these two men had been waiting for
him to come out and then followed him.
BACKGROUND:
1. For the last six months persons have seen,
apparently members of state security organisations, snooping on
Francisco’s home, the union offices and the places that he
frequents such as churches, NGOs and universities where he has presented
the results of his invetsigations into mining and multinationals
in Colombia.
2. The work of harassment and intelligence has
extended to others such as Ludivia Giraldo, in charge of Sintraminercol’s
human rights department and the legal representative of the NGO
"Ecate" - Association for Integral Social Development
Desarrollo Social Integral - that has its office in the Sintraminercol
headquarters. The most worrying incident occurred on Wednesday 29
September 2004 when four young men dressed in civilian clothes travelling
in a yellow public service taxi followed her movements from 6 p.m.
to 8:30 p.m. through the districts of San Antonio Sur, Restrepo
and Alquería in Bogotá. The situation obliged her
to go to the human rights section of the National Police to ask
for help.
3. The workers at state mining corporation Minercol,
trade unionists and defenders of human rights have been attacked
when they carried out peaceful protests opposite the plants of Holcim
corporation. They have been filmed, photographed and attacked with
streams of high pressure water, dogs and security personnel who
also verbally assaulted the women protesters. The destination and
use of photographs taken by the Consular Police at between 11 a.m.
and 11:30 a.m on 8th June 2004 in the entrance to the Swiss Embassy
is not known. Sintraminercol and the other signing organisations
state our concern that these films and photographs might fall into
the hands of military-paramilitary groups who are directly responsible
for the repression and extermination of trade unionists and social
leaders.
4. On 2nd May 2004 two explosive devices were
placed and detonated at Sintraminercol’s headquarters. On
1st May officers of SIPOL (National Police Intelligence Service)
were in two vehicles (a white Renault and a yellow taxi) in front
of the building where the union’s offices are located. There
is no known result of the investigation, and they have not even
called Francisco Ramírez to ratify the statement of what
happened on the day following the attempt, all that the union has
received is a communication from the Attorney in which the closure
of the ivestigation was announced.
5. It is public knowledge that through repeated
denouncements by NGOs and by the population of the Ciudad Bolívar,
that the paramilitary groups operate with the National Police, and
it is very suspicious that members of SIPOL had been present just
before the explosions took place making a security study, which
also included the address and the particulars of the place where
yesterday’s assassination attempt occurred.
6. This new attempt, from which Francisco Ramírez
fortunately emerged unhurt, occurs in the midst of the union’s
fight against the liquidation of the state mining corporation Minercol.
This has been ordered by the government of Alvaro Uribe Velez to
implement the demands of the multilateral banks and of Swiss, Canadian,
UK and US multinational corporations whose lawyers have elaborated
and advised on rewriting the Mining Code legislation to include
articles liquidating Minercol and attacking human rights, the environment
and the existence of peasant, mining, indigenous and Afro-Colombian
communities.
REQUESTS
The Colombian State to adopt the measures necessary
to guarantee the life and security of Francisco Ramírez Cuellar,
president of Sintraminercol.
The Colombian Government and representatives of
the multinational companies that exploit the mineral resources of
Colombia to meet together with Sintraminercol in seeking ways to
stop the repression and alternatives to the liquidation of Minercol.
The legal representantive of Swiss company HOLCIM
in Colombia and the diplomatic representantives to state the destination
of the photographs and films taken of Francisco Ramírez Cuellar,
and of the human rights defenders, Minercol workers and trade unionists
who participated in the meetings and protests opposite the company’s
headquarters and the Swiss Embassy in Bogotá.

HUMANOS ABAJO FIRMANTES DENUNCIAMOS UN NUEVO ATENTADO CONTRA FRANCISCO
RAMIREZ CUELLAR, PRESIDENTE DE SINTRAMINERCOL Y HACEMOS UN LLAMADO
A LA SOLIDARIDAD DE LA COMUNIDAD NACIONAL E INTERNACIONAL PARA EVITAR
QUE CONTINUE EL EXTERMINIO CONTRA EL MOVIMIENTO SINDICAL EN COLOMBIA.
HECHOS:
1.- El día domingo 10 de Octubre de 2004
a la 1:30 p.m. cuando el presidente de Sintraminercol, Francisco
Ramírez Cuellar, salió de su casa de habitación
y se dirigía a almorzar en compañía de niñas,
al llegar a la esquina de la Calle 49 con Carrera 15 barrio Palermo
de la ciudad de Bogotá, observó que apareció
una motocicleta de alto cilindraje de color negro y rojo con dos
personas a bordo que trataban de acercársele, una de estas
personas, el parrillero lo miraba fijamente y tenia una pistola
en su mano derecha sobre la pierna, de inmediato Francisco se ubicó
detrás de los postes de energía y teléfonos
dejando al sicarios sin blanco para disparar, en ese instante el
semáforo que estaba en rojo cambió a verde y ante
la insistencia de vehículos que estaban detrás de
ellos, arrancaron tomando la vía hacia el sur.
2.-Francisco Ramírez pudo observar que
la motocicleta no tenía placas y que las dos personas no
llevaban los chaleco reflectivos ni cascos, elementos que deben
portar las personas que se movilizan en estos vehículos.
Ese mismo día y en días anteriores se ha observado
vigilancia alrededor de la casa de habitación de Francisco
Ramírez, por lo cual se presume que estos hombres esperaron
a que saliera y lo siguieron.
ANTECEDENTES
1.- Durante los últimos seis meses del
presente año se ha observado personas al parecer miembros
de organismos de seguridad del Estado, en labores de seguimiento
alrededor de la casa de habitación de Francisco Ramírez,
las oficinas del Sindicato, lugares que frecuenta como iglesias,
Ong y en algunas universidades donde ha presentado los resultados
de la investigación sobre minería y multinacionales
en Colombia.
2. Las labores de hostigamiento e inteligencia
también se han hecho extensivas a otras personas como a Ludivia
Giraldo, encargada del departamento de derechos humanos de Sintraminercol
y representante legal de la Ong de derechos humanos Asociación
para el Desarrollo Social Integral "Ecate" que tiene la
oficina en el misma sede de Sintraminercol; siendo la más
preocupante la realizada el día miercoles 29 de septiembre
de 2004 por cuatro hombres jóvenes vestidos de civil que
se movilizaban en una taxi de servicio público color amarillo
que la siguieron entre las 6 p.m. y las 8:30 p.m. en desplazamientos
que tuvo por los barrios San Antonio Sur, Restrepo y Alquería
en la ciudad de Bogotá, situación que obligó
a que ella acudiera a derechos humanos de la Policía Nacional
para solicitar ayuda.
3. Los trabajadores(as) de Minercol, sindicalistas
y defensoras(es) de derechos humanos han sido agredidos cuando han
realizado protestas pacíficas frente a las instalaciones
de la compañía Holcim, han sido filmados, fotografiados
y agredidos con chorros de agua a gran presión, perros y
personal de seguridad que además han agredido verbalmente
a las mujeres. Se desconoce el destino y la utilización de
las fotografías tomadas por dos hombres (cuyas identificaciones
tiene los miembros de la Policía consular) el día
8 de junio de 2004 entre 11 y 11:30 a.m., a la entrada de las oficinas
de la embajada Suiza en Colombia,. Sintraminercol y demás
organizaciones firmantes manifestamos nuestra preocupación
sobre el peligro que significa que estas filmaciones y fotografías
lleguen a manos de grupos militares-paramilitares, responsables
directos de la represión y el exterminio de sindicalistas
y lideres sociales.
4.- El día 2 de Mayo de 2004 fueron colocados
y estallaron dos petardos en la sede sindical de Sintraminercol,
el día 1 de mayo hubo presencia de funcionarios de la SIPOL
(servicio de inteligencia de la Policía Nacional) frente
al edificio donde funcionan las oficinas del sindicato en dos vehículos
(Renault color blanco y un taxi color amarillo). Después
de cinco meses después de denunciados los hechos, la Fiscalía
5 delegada ante la SIJIN (Servicio de Inteligencia de la Policía)
no se conoce ningún resultado positivo de la investigación,
ni siquiera han llamado a Francisco Ramírez a ratificar las
denuncias presentadas al día siguiente de ocurrido el atentado,
pero se recibió en el Sindicato una comunicación de
la Fiscalía en la cual anuncian el cierre de la investigación.
5.- Es de público conocimiento por reiteradas
denuncias de Ongs y de la población de Ciudad Bolívar,
que los grupos paramilitares operan con la Policía Nacional
y es muy sospechoso que miembros de la SIPOL hayan estado previamente
al estallido de los petardos contra la sede sindical, hayan hecho
estudios de seguridad que tenían la dirección y las
señas particulares del sitio donde ayer ocurrió este
intento de asesinato.
6.- Este nuevo atentado del que afortunadamente
salió ileso Francisco Ramírez, se presenta en medio
de la lucha de la organización sindical adelanta contra la
liquidación de Minercol ,ordenada por el Gobierno de Alvaro
Uribe Velez en cumplimiento de las imposiciones de la Banca Multilateral
y de las compañías multinacionales (suizas, canadienseses,
inglesas, norteamericanas) cuyos abogados han elaborado y asesorado
la reglamentación de la legislación minera (código
de minas), incluyendo artículos que inducen a la liquidación
de la empresa estatal minera Minercol y que atentan contra los derechos
humanos, el medio ambiente y la existencia de las comunidades campesinas,
mineras, indígenas y afrocolombianas.
SOLICITUDES
Al Estado colombiano para que adopte las medidas
necesarias para garantizar la vida y seguridad de Francisco Ramírez
Cuellar, presidente de Sintraminercol
Al gobierno colombiano, a los representantes de
las compañías multinacionales que explotan los recursos
mineros en Colombia, para que se adelanten acercamientos con Sintraminercol
tendientes a parar la represión y a buscar alternativas que
pare la liquidación de Minercol
Al representante legal de la compañía
suiza HOLCIM en Colombia y a los representantes diplomáticos,
para que manifiesten cual fue el destino de las fotografías
y filmaciones tomadas a Francisco Ramírez Cuellar, a los
y las defensoras de derechos humanos, trabajadoras y trabajadores
de Minercol y sindicalistas que participaron en los mítines
y jornadas de protesta frente a la sede de la compañía
y de la embajada de Suiza en Bogotá.
