1. On Saturday 12 May 2007, the Red Europea de Hermandad y Solidaridad con Colombia (European Network of Brotherhood/Sisterhood and Solidarity with Colombia) received an e-mail threatening the life, physical integrity and accompaniment work of the international organisations that support the communities of Sur de Bolívar.

2. The same threatening message was sent to the leaders of the Federación Agrominera del Sur de Bolívar, principally its president TEOFILO MANUEL ACUÑA, who was days before the victim of a judicial frame up by the Nueva Granada Batallion of the 5th Brigade of the Nacional Army [see previous Urgent Action – released 5 May 2007].

3. The message was received at e-mail address This email address is being protected from spam bots, you need Javascript enabled to view it , and sent from a Hotmail server under the name “Juan David González Morales”, account This email address is being protected from spam bots, you need Javascript enabled to view it The text of the message is:

“it worries me a lot the attitude of the attorney in simiti plutarco all the ngo’s that were pressurising so that the terrorist was set free who has harmed the mining population of sur de bolivar it is known that teofiloy many leaders divert mining resources to maintain and strengthen narcoterrorist organisations such as the ELN but that with the grace of God this will end very soon and these foreigners from the ngo’s will go back to their own lands because they will be some day be discovered by the army of God legally constituted”

4. This threat is not an isolated incident, but part of the declared persecution of the communities of Sur de Bolívar and the national and international organisations that accompany their social processes in defence of territory and life.

5. Since the multinational Anglo Gold Ashanti through its subsidiary Kedahda, has decided to appropriate the territory of the small miners in Sur de Bolívar, human rights violations by the Colombian Armed Forces have increased. The Armed Forces in the region have publicly stated that they are the security service for the said multinational.

6. Innumerable forms of terror have been used to destroy the organisational processes in the region, and to oblige the inhabitants to give up land to Anglo Gold Ashanti, including: the burning of homes, thefts, looting, stigmatisation, threats, occupation of civil goods, arbitrary detentions, judicial set-ups and extra-judicial executions. All these actions are employed to try and displace the mining communities from the region. To these is now added the latest event which is a serious threat to the defence of human rights in Colombia.

7. In accord with the commitment made by the international organisations to the Colombian social organisations to defend the Rights of the Peoples, the international accompaniment in Sur de Bolívar and in the other regions by the Red Europea de Hermandad y Solidaridad will continue. We hold Kedahda corporation (Anglo Gold Ashanti) and the Colombian state responsible for any actions against the life and integrity of the internationals who carry out their work in Sur de Bolívar.

Background to these events

1. On 23 September 2006, in the town of Santa Rosa, whilst the communities carried out a day of protest against the assassination of their leader ALEJANDRO URIBE CHACON, members of the Nueva Granada Battalion of the 5th Brigade of the Nacional Army filmed and photographed members of the Red in a clandestine and covert manner. They also filmed the Legal Representantive of the Colombian NGO Corporación Sembrar, the legal adviser of the Miners Federation of Sur de Bolívar, and some leaders of the region. One of those responsible for the filming was evidently a military agent who was transported in a van registration number XVP 848 used by Carlos Franco, director of the Office of the Presidencial Human Rights Programme. This was the subject of a complaint to the Regional Peoples Defender, and in spite of an immediate request to the Commander of the Nueva Granada to identify the soldier and erase the photographs, he refused to do so.

2. On 14 December 2006 an article appeared in the regional newspaper called “El Frente”, which is headquartered in the city of Bucaramanga. The article is headed: “Perverse campaign against Military Forces in Sur de Bolivar carried out by Non-Governmental Organisations who endorse and defend terrorism in the region”. The article argues that the guerrillas act through the “NGOs in the region”; branding as such Corporación Sembrar, the Miners Federation of Sur de Bolívar and the Red Europea de Hermandad y Solidaridad con Colombia. In similar fashion the article claims that the efforts of these organisations is directed at “discrediting the Nueva Granada Artillery Battalion and hence the 5th Brigade”.

3. The article contains an interview with José Cendales, a moneyed man from the region who is being suggested as a mayoral candidate for Santa Rosa, who says “the people doing these marches aren’t themselves capable. There is the influence of some group”, referring to the marches of the artisan miners last September 2006.

4. At approximately 14:30 on Saturday 28 April 2007, two internationalists accompanying three regional leaders at San Luquitas, in the San Pedro Frío district Santa Rosa were detained and their details taken.

5. Similarly on Sunday 29 April 2007, three members of the Red Europea de Hermandad y Solidaridad con Colombia had their details taken by members of the Nueva Granada Battalion, and recorded in a notebook that is kept in the Battalion’s military base in San Luquitas, San Pedro Frío district.

6. Captain Cruz of the Nueva Granada Battalion has in recent weeks been making accusations against the artisan miners federation whose president was detained, such as “we have caught the worst bandit in Sur de Bolívar who robbed $500,000 million pesos from Social Action to hand them over to the guerrilla… we will persecute the rest of the bandits who follow him”. At the same time Captain Cruz has been insistently inquiring in the communities for the presence of members of the Red de Hermandad and other international accompaniment organisations asking about their finances, origins, function and identification.

REQUESTS

The National Government:

1. That the National Government takes the necessary measures to respect and guarantee the work of international organisations that carry out accompaniment with the communities, and social and human rights organisations in Colombia.

2. That the National Government headed by the Vice-President of the Republic makes a public recognition of the accompaniment carried out by international NGOs in Colombia.

3. That the National Government fully implements the agreements signed with the communities and guarantees that the members and leaders of the Federación Agrominera del Sur de Bolívar, and the organisations forming the federation, may exercise their rights by providing them with the protection necessary for their life and physical integrity.

4. That at the same time the work of Colombian human rights and social organisations working in Sur de Bolívar be respected, and that consequently the Public Forces cease their stigmatisation of these organisations.

To the audit and judicial organisations:

5. That the origins of the electronic mail be investigated, and those responsible be punished in exemplary manner.

6. That members of the Nueva Granada Battalion be investigated and punished for their accusations and stigmatisation of the social organisations of Sur de Bolívar, their community leaders and for the irregular procedures committed against the international organisations accompanying the region.

7. That all the human rights violations committed against the communities of Sur de Bolívar be investigated and punished, as have been insistently denounced by the region’s social organisations and accompanying organisations.

AMENAZADAS ONGS INTERNACIONALES EN COLOMBIA

CONTINÚA LA ESTRATEGIA DE LA ANGLO GOLD ASHANTI

Organizaciones internacionales y nacionales que acompañan las comunidades del Sur de Bolívar han sido amenazadas así como todos los líderes agromineros.

1. El día sábado 12 de mayo de 2007, se recibió en uno de los correos electrónicos de la Red Europea de Hermandad y Solidaridad con Colombia, un mensaje que amenaza, la vida, integridad física y la labor de acompañamiento de organizaciones internacionales que apoyan las comunidades del Sur de Bolívar.

2. El mismo mensaje amenaza igualmente a los líderes de la Federación Agrominera del Sur de Bolívar, principalmente al presidente de ésta, TEOFILO MANUEL ACUÑA, quien en días pasados fue víctima de sendo montaje judicial por parte del Batallón Nueva Granada, adscrito a la V Brigada del Ejército Nacional.

3. El mensaje fue recibido en el correo This email address is being protected from spam bots, you need Javascript enabled to view it , y enviado desde un correo electrónico del servidor hotmail, cuya aparente procedencia corresponde a “Juan David González Morales” con el correo This email address is being protected from spam bots, you need Javascript enabled to view it El texto del mensaje es el siguiente:

“me preocupa mucho la la actitud del fiscal de simiti plutarco sobre todo de las ong's que lo estubieron presionando para que dejaran en libertad a este terrorista que solo le hace daño a la poblacion minera del sur de bolivar se sabe que teofiloy muchos dirigentes desvian los recursos de las minas para mantener y fortaleser a las organizaciones narcotereroristas como el ELN pero con el favor de Dios eso muy pronto va a terminar y esos extranjeros de las ong's van a estrañar mucho sus tierras oriundas porque seran algun dia descubierto por el ejercito de Dios lagalmente constituido”

4. Esta amenaza no es un hecho aislado, hace parte de una persecución declarada contra las comunidades del Sur de Bolívar y las organizaciones nacionales e internacionales que acompañan sus procesos sociales en defensa del territorio y la vida.

5. Desde que la Multinacional Anglo Gold Ashanti a través de su filial Kedahda, ha decidido apropiarse del territorio de los pequeños mineros en el Sur de Bolívar, han aumentado las violaciones a los derechos humanos por parte de las Fuerzas Militares de Colombia, quienes públicamente han manifestado que se encuentran en la región al servicio de la seguridad de dicha Multinacional.

6. Las modalidades de terror utilizadas para destruir los procesos organizativos de la región y obligar a ceder el terreno a la Multinacional Anglo Gold Ashanti, han sido innumerables; quema de viviendas, hurtos, saqueos, señalamientos, amenazas, ocupación de bienes civiles, detenciones arbitrarias, montajes judiciales y ejecuciones extrajudiciales entre otras, son los hechos con los que se ha pretendido desplazar a las comunidades mineras de esta región del país. A esto se le suma el hecho aquí narrado que constituye una grave amenaza para la defensa de los derechos humanos en Colombia.

7. De acuerdo al compromiso que han adquirido las organizaciones internacionales con las organizaciones sociales colombianas de defender los Derechos de los Pueblos, el acompañamiento internacional en el Sur de Bolívar y en las demás regiones de Colombia continuará por parte de la Red Europea de Hermandad y Solidaridad con Colombia. Responzabilizamos desde ahora a la Empresa Kedahda (Anglo Gold Ashanti) y al estado colombiano por las porsibles acciones en contra de la vida y la integridad de los internacionales que desarrollan su trabajo en el Sur de Bolívar.

Antecedentes relacionados con los hechos

1. El día 23 de septiembre de 2006, en el casco urbano del Municipio de Santa Rosa, mientras las comunidades adelantaban la jornada de protesta por el asesinato de su líder ALEJANDRO URIBE CHACON, miembros del Batallón Nueva Granada, adscritos a la V Brigada del Ejército Nacional, de manera clandestina y encubierta, filmaron y fotografiaron miembros de la Red Europea de Hermandad y Solidaridad, la Representante Legal de la Corporación Sembrar, el asesor Jurídico de la Federación Agrominera del Sur de Bolívar y algunos líderes de la región. Uno de los responsables de estos registros fílmicos, al parecer militar, se desplazaba en la Comitiva del director de la Oficina del Programa Presidencial de Derechos Humanos, Carlos Franco, en la camioneta XVP 848. El hecho fue denunciado ante el Defensor Regional del Pueblo, y pese a que este solicitó de manera inmediata al Comandante del Batallón Nueva Granada, identificar el militar y borrar las fotografías, este se rehusó a hacerlo.

2. El día 14 de diciembre de 2006, fue publicado un artículo en el periódico denominado “El Frente”, de circulación regional y cuya sede principal se encuentra en la ciudad de Bucaramanga. El precitado artículo es titulado: “Perversa campaña contra Fuerzas Militares en el Sur de Bolívar, adelantan Organizaciones No Gubernamentales que patrocinan y defienden el terrorismo en la región”. Así mismo manifiesta el artículo, que la guerrilla actúa a través de las “ONG existentes en la región”; señalando como tal a la Corporación Sembrar, a la Federación Agrominera del Sur de Bolívar y a la Red Europea de Hermandad y Solidaridad con Colombia. De la misma manera manifiesta que la labor de estas organizaciones está dirigida a “desprestigiar el Batallón de Artillería Nueva Granada y por ende a la Quinta Brigada”.

3. El artículo contiene apartes de una entrevista que le hicieron a José Cendales, un señor adinerado de la región, el cual se viene postulando como candidato a la Alcaldía del municipio de Santa Rosa y quien ha señalado que ““en esas marchas la gente así solas no son capaces. Eso es porque tienen influencia de algún grupo”, refiriéndose a las marchas que se desarrollaron por parte de los agromineros el Sur de Bolívar, el pasado mes de septiembre de 2006.

4. El sábado 28 de abril de 2007, aproximadamente a las 14 horas 30 minutos, fueron retenidos y reseñados por el Batallón Nueva Granada, en la vereda San Luquitas, del corregimiento San Pedro Frío del municipio de Santa Rosa, dos internacionales que acompañaban a 3 líderes de la región.

5. De la misma manera el domingo 29 de abril de 2007, tres miembros de la Red Europea de Hermandad y Solidaridad con Colombia, fueron reseñados por miembros del Batallón Nueva granada, en un cuaderno que reposa en la base militar de este Batallón ubicada en la vereda San Luquitas del corregimiento San Pedro Frío.

6. El capitán Cruz del Batallón Nueva Granada, ha venido en las últimas semanas, luego de la detención del presidente de la Federación Agrominera del Sur de Bolívar, haciendo señalamientos en contra de la Federación Agrominera y su presidente “hemos cogido al peor bandido del Sur de Bolívar que le robó $500.000 millones de pesos a Acción Social para entregarlos a la guerrrilla… perseguiremos al resto de bandidos que lo siguen a él” Así mismo el Capitán Cruz, ha estado indagando insistentemente en las comunidades por la presencia de los miembros de la Red de Hermandad y otras organizaciones internacionales acompañantes, preguntando por su financiación, procedencia, función e identificación.

SOLICITUDES

Al Gobierno Nacional:

1. Que el Gobierno Nacional, tome las medidas necesarias para que sea respetada y garantizada la labor que cumplen las organizaciones internacionales que hacen acompañamiento a comunidades y organizaciones sociales y de derechos humanos en Colombia.

2. Que el gobierno Nacional en cabeza del Vicepresidente de la República, haga un reconocimiento público a la labor de acompañamiento que desarrollan las ONGs internacionales en Colombia.

3. Que el gobierno Colombiano, dé pleno cumplimiento a los acuerdos firmados con las comunidades y garantice el ejercicio de los derechos de los integrantes y dirigentes de la Federación Agrominera del Sur de Bolívar y de las organizaciones que las conforman brindando la protección necesaria para su vida e integridad física.

4. Que sea respetada así mismo, la labor que ejercen las organizaciones de derechos humanos y sociales de Colombia, que trabajan en la región del Sur de Bolívar y por consiguiente cesen los señalamientos de la Fuerza Pública contra ellas.

A los organismos de control y judiciales

5. Que se investigue la procedencia del correo electrónico y sus responsables sean sancionados ejemplarmente.

6. Que sean investigados y sancionados los miembros del Batallón Nueva Granada, por las acusaciones y señalamientos contra las organizaciones sociales del Sur de Bolívar, sus dirigentes comunitarios y por los procedimientos irregulares cometidos contra las organizaciones internacionales que acompañan en la región.

7. Que sean investigadas y sancionadas todas las violaciones a los derechos humanos cometidas contra las comunidades del Sur de Bolívar, que han sido denunciadas insistentemente por las organizaciones sociales de la región y organizaciones acompañantes.
