| In response to their complaints and claims, the campesinos have been victim of threats, intimidation, murder and displacement, by the Armed Forces and the paramilitaries. The paramilitaries have accused the families of being subversives, but the real reason for the persecution is to create panic, confusion and anxiety in order that they desist with their claims against these companies. The implementation of the neoliberal model by Alvaro Uribe Velez’ government has established guarantees and perks for multinational companies, so that they obtain the greatest possible benefits at the cost of poverty, misery and violence for the Colombian people, and environmental destruction. This case of the campesinos is a clear example of this. The 1991 Constitution establishes Colombia as a ‘Social State of Law’, organised as a unitary republic, participative, democratic and pluralist, fundamentally based on the respect for human dignity, on the work and the solidarity of those people who make up its population, and on the prevalence of the ‘general interest’. The State is also charged with facilitating the participation of all individuals in decisions that affect them, and in the economic, political, administrative and cultural life of the nation, applied equally to all. These are however just empty words. The President and his officials violate and permit to be violated all the constitutional precepts that embody the fundamental rights of all Colombians. The cases for environmental damage brought before the Minister of the Environment, the human rights cases brought before the Attorney General’s Office and the Peoples Ombudsman, and the civil cases brought before the courts, have been manipulated to such an extent that the campesinos remain in the same abyss of fear, hunger, uncertainty and despair without any likely solution to bring an end to this cruelty. Justice has been denied to them by the very State charged with applying the law. Inexplicably, evidence of damages caused has been gathered, using the personnel and equipment of the companies accused, completely behind the backs of the victims and their lawyers. For this reason we have been unable to exercise our constitutional rights of defence and cross examination. State officials, completely shamelessly, have refused to inform us of the progress of their investigations, and have even lost the evidence. Thus began the cruel game of treachery and the buck passing that merely encourages impunity and injustice. Those state officials and journalists that actually tried to investigate the claims and expose the truth found themselves transferred or taken off the case. Having exhausted all possible legal avenues in Colombia, as is also true of a community in Arauca who have suffered similar human rights and environmental abuses at the hands of the same companies, the campesinos’ Colombian lawyers working with lawyers in the UK and the Colombia Solidarity Campaign are currently in the process of copying and translating evidence (reports on the environment, human rights and the social impact of the pipelines) taking witness testimonies, drawing up chronologies of all events and their results, with the possible end of bringing an international case against BP and the other companies involved. La Historia Tragica Sembrada Por BP En Colombia Continua
La tragedia continua par las familias campesinas victimas de la perdida y destrucción de sus tierras con ocasión a la construcción de dos oleoductos en 1990-1991 y 1995-1996, a su paso por los municipios de Zaragoza y Segovia Antioquia por parte de las sociedades “O. de C. y “OCENSA”. Por sus quejas y reclamos han sido asesinados, amenazados, desplazados e intimidados, tanto por la fuerza publica como por los paramilitares siendo sindicados por este hecho de ser subversivos, cuando el verdadero objetivo es crear pánico, confusión y zozobra para obtener el desistimiento a sus pretensiones en contra de estas empresas. La implementación del esquema neoliberal por parte del Gobierno Nacional, establece garantías y prebendas para que las empresas multinacionales obtengan en Colombia mayores beneficios o todas las de ganar en contra y a costa de crear pobreza, miseria y violencia para el pueblo colombiano y sin importar tampoco la destrucción del medio ambiente, constituyéndose este caso un claro ejemplo de esta realidad. La Constitución de Colombia de 1991 establece que Colombia es un Estado Social de Derecho, participativa, democrática y pluralista, fundamentada en el respeto de la dignidad humana, en el trabajo y la solidaridad de las personas que la integran y en la prevalencia del interés general, además que el estado facilitara la participación de todos en las decisiones que los afecten y en la vida económica, política, administrativa y cultural de la nación, en igualdad de condiciones. Pero esto es letra muerta, el presidente y funcionarios violan y permiten que se violen los preceptos constitucionales que consagran los derechos fundamentales de los colombianos. Las denuncias en material ambiental ante el Ministerio de Medio Ambiente, en material de derechos humanos ante La Procuraduría General de la Nación y Defensoria del Pueblo y en material civil ante Juzgados y Tribunales, han sido manipulados y dilatados hasta el punto de que a la fecha los campesinos siguen en el abismo del temor, del hambre, la incertidumbre y la desesperanza sin que haya una solución que ponga fin a esta crueldad. La justicia les ha sido negada nada mas que por el estado a quien le corresponde aplicarla e imponerla. Las pruebas son realizadas con participación de estas empresas, con sus maquinarias y equipos suyos y a ocultas de los campesinos y sus abogados, razones por las cuales no se puede ejercer el derecho a la defensa y contradicción de argumentaciones, dentro del marco constitucional. Sin la vergüenza en el rostro los funcionarios del estado se niegan a dar información de las investigaciones, dicen desconocer de sus paraderos y empiezan el cruel juego a la traición consistente en chuitarsen la pelota de unos para otros sin resolverse la situación, imperando la impunidad y la injusticia. Los funcionarios estatales y periodistas que honestamente han querido investigar, han sido retirados o trasladados con la finalidad de que no continúen en su labor. Habiéndose agotado todas las instancias a nivel nacional sin que se haya llegado a una solución justa, un grupo de abogados colombianos en asocio con otro grupo de abogados del Reino Unido, realizan la tarea de la recopilación de evidencias autenticas traducidas al ingles (estudios, informes en material ambiental, derechos humanos, económicos y de impacto social) recepción de testimonios, cronología de hechos y consecuencias, todo con la finalidad de llevar a la BP ante un tribunal internacional.
